Data protection

Personal data (hereinafter referred to as “data”) is processed on this website only within the scope of requirements and for the purpose of providing a user-friendly and functional website, with its services and content, in accordance with Article 4 paragraph 1 of Regulation (EU) 2016/679, known as the General Data Protection Regulation (hereinafter referred to as “GDPR”), is in principle any process that is carried out with or without the help of automated methods in connection with personal data. This includes recording, collecting, ordering, organizing, storing, modifying or adapting, reading, querying, using or publishing through transmission, distribution or other types of provision, reconciliation or linking, restriction, deletion or destruction. With the following privacy policy, we provide information in particular about the scope, type, purpose, duration and legal basis of the processing of personal data, insofar as we decide on the processing alone or together with third parties. We also provide information about the third-party components used to optimize and improve the quality of use, in particular when third parties have to process data on their own responsibility.

Rights of users and data subjects
With regard to the data processing described in more detail below, users and data subjects have the right to confirmation as to whether data concerning them is being processed, to information about the processed data, to further information about the data processing and to copies of the data (see also Article 15 GDPR);

... to a complaint to the supervisory authorities if there is a suspicion that data concerning you has been processed by the provider in a way that violates data protection regulations (Article 77 GDPR).

The provider is obliged to notify all addressees who have received the data from him of any correction or deletion of data or of any restriction of processing carried out on the basis of Articles 16, 17 para. 1, 18 GDPR. This obligation only exists if the notification is not impossible or cannot be provided with a reasonable amount of effort. In principle, the user has the right to information about the recipients. Users or data subjects under Article 21 GDPR have the right to object to the future processing of data concerning them if the data is processed by the provider in accordance with Article 6 (1) GDPR. In particular, objection to data processing for the purpose of direct marketing is admissible.

Information about data processing
For technical reasons, the following data, which is collected by the Internet browser you are using, is transmitted to us and/or to the provider. These are so-called server log files: type of browser and its version, operating system, referrer URL, IP address, date and time of access, duration of access. This anonymous data is stored separately from any personal data that may have been entered and does not allow any conclusions to be drawn about specific persons. They are used for statistical purposes and also to improve the website.

For technical reasons, in particular to ensure a secure and stable Internet presence, data is transmitted to us or to our web space provider through your Internet browser. These so-called server log files collect, among other things, the type and version of your Internet browser, the operating system, the website from which you switched to our website (referrer URL), the website (s) of our website that you visit, the date and time of the respective access and the IP address of the Internet connection from which you use our website. The data collected in this way is temporarily stored, but not together with other data from you. This storage is carried out on the legal basis of Art. 6 para. 1 lit. f) GDPR. This data will be deleted after seven days at the latest, unless storage is necessary for evidentiary purposes.

As a result, individual information about you, such as browser or location data and your IP address, is stored and processed. This is used to make our website user-friendly and secure and to be able to use shopping basket functions or different languages. The legal basis is Art. 6 para. 1 lit b.) GDPR, when these cookies data are used to initiate or process contracts. If this purpose does not exist, our legitimate interest is in optimising the website. In this case, the legal basis is Art. 6 para. 1 lit. f) GDPR. Session cookies are deleted when you close the browser.

Online job applications and publication of job advertisements
Applicant data is collected by us for the purpose of processing an application and processed electronically. When an employment contract is concluded, this data can be used for the purpose of the contract if no ordinances or regulations prohibit its use. If the applicant is rejected, the data will be deleted from the time of rejection, after six months, unless there are legal regulations that prohibit this. You also have the option of agreeing to the use of your application over a different period of time, which you must actively explain to us.

Contact requests/contact option
If you contact us via a contact form or by e-mail, the data you send will be processed by us to process your contact for you. The legal basis for this processing is Art. 6 para. 1 lit. b) GDPR. Once your request has been completed, we will delete this data unless a legal regulation regulates another procedure.

Applicant data protection

We are pleased that you would like to apply to us. In the following, we explain how we process your personal data as part of an application and provide further relevant information in this context.

1. Who is responsible for processing your personal data?
HW-Ingenieure GmbH, Hardenbergstraße 27 in 10623 Berlin (hereinafter referred to as “we”, is responsible within the meaning of the EU General Data Protection Regulation (“GDPR”).

2. Data protection officer

3. For which purposes and on which legal basis do we process personal data?We process personal data about you for the purpose of applying for an employment relationship, insofar as this is necessary to decide whether to establish an employment relationship with us. The legal basis for this is Section 26 (1) in conjunction with Section 8 (2) BDSG. We may also process personal data about you insofar as this is necessary to defend against us arising from the application process. The legal basis is Article 6 (1) (f) GDPR; the legitimate interest is, for example, a duty of proof in proceedings under the General Equal Treatment Act (AGG).
Insofar as there is an employment relationship between you and us, in accordance with Section 26 (1) BDSG, we may further process the personal data already received from you for employment purposes if this is necessary to carry out or terminate the employment relationship or to exercise or fulfill the rights and obligations of representing the interests of employees arising from a law or a collective agreement, a company or service agreement (collective agreement).

4. Which categories of personal data do we process?
We process data related to your application. This may include general information about you (such as name, address and contact details), information about your professional qualification and education, or information about continuing vocational training, or other information that you provide to us in connection with your application. In addition, we may process job-related information that you have made publicly available, such as a profile on professional social media networks.

5. What sources does personal data come from if we do not collect it from you?Insofar as we do not collect the data directly from you and you have an active profile on a job portal or a professional social media network, or disclose an inactive or only partially active profile to us as part of the application process, we may also collect personal data about this.

6. What categories of recipient data are there?
We may transfer your personal data to companies affiliated with us (companies of ECG — Engineer Corporation Group GbR), insofar as this is permitted within the scope of the purposes and legal bases set out in Section 3. In addition, personal data is processed on our behalf on the basis of contracts in accordance with Art. 28 GDPR. In particular, these may be host providers or providers of applicant management systems.

7. Is the transfer to a third country intended?
A transfer to a third country is not intended.

8. How long will your data be stored?
We store your personal data for as long as is necessary to decide on your application. If there is no employment relationship between you and us, we will delete the data submitted to us two months after notification of the cancellation. However, the data will not be deleted if, due to legal provisions, for example due to evidentiary obligations under the AGG, require longer storage of up to four months or until the conclusion of legal proceedings.
In this case, the legal basis is Art. 6 para. 1 lit. f) GDPR and § 24 para. 1 no. 2 BDSG. Our legitimate interest lies in legal defense and enforcement.

9. What are your rights?
As an applicant with us, you have the following data protection rights in individual cases, to exercise which you can contact us or our data protection officer at any time using the details set out in sections 1 and 2:
a. Information
You have the right to obtain information about your personal data processed by us and to request access to your personal data and/or copies of this data. This includes information about the purpose of use, the category of data used, its recipients and access rights and, if possible, the planned duration of data storage or, if this is not possible, the criteria for determining this duration.
b. Correction, deletion or restriction of processing
You have the right to request that we correct incorrect personal data concerning you without undue delay. Taking into account the purposes of processing, you have the right to request the completion of incomplete personal data — including by means of a supplementary statement.
c. Right of objection
Insofar as personal data concerning you is processed on the basis of Article 6 (1) (f) GDPR, you have the right to object to the processing of this data at any time for reasons arising from your particular situation. We will then no longer process this personal data unless we can prove compelling legitimate grounds for processing that outweigh your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.
d. Right of withdrawal
If the processing is based on consent, you have the right to withdraw the consent at any time without affecting the lawfulness of the processing carried out on the basis of the consent up to the withdrawal. To do this, you can send us an email to datenschutz@hwingenieure.de

e. Right to deletion
You have the right to request that we delete personal data concerning you immediately, and we are obliged to delete personal data immediately if one of the following reasons applies: The personal data is no longer necessary for the purposes for which it was collected or otherwise processed. You object to the processing in accordance with point 8.c above and there are no overriding legitimate reasons for the processing. The personal data was processed unlawfully. The deletion of personal data is necessary to fulfill a legal obligation under Union law or the law of the Member States to which we are subject. This does not apply insofar as processing is necessary: to fulfill a legal obligation that requires processing under Union or Member State law to which we are subject; to assert, exercise or defend legal claims.
f. Right to restrict processing
You have the right to request us to restrict processing if one of the following conditions is met: the accuracy of the personal data is disputed by you, for a period of time which enables us to verify the accuracy of the personal data, the processing is unlawful and you refuse to delete the personal data and instead demand that we no longer use the personal data for the purposes of processing but you need them to assert, exercise or defend legal claims, or you have filed an objection to processing in accordance with point 8.c above, as long as it is not yet clear whether our legitimate reasons outweigh yours. If processing has been restricted in accordance with this letter, this personal data — apart from storage — may only be processed with your consent or to assert, exercise or defend legal claims or to protect the rights of another natural or legal person or for reasons of important public interest of the Union or a Member State. If you have obtained a restriction on processing, we will inform you before the restriction is lifted.
g. Right of appeal
Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement, if you believe that the processing of personal data concerning you is contrary to the GDPR.

10. Necessity of providing personal data
The provision of personal data is not required by law or contract, nor are you obliged to provide the personal data. However, the provision of personal data is necessary to conclude an employment contract with us. This means that unless you provide us with any personal data when applying for a job, we are unfortunately unable to enter into an employment relationship with you.
